Well, howdy there, internet people, it's Beau again.
So today, we are going to talk about Trump
and being quiet and dates
and being careful what you wish for.
Because sometimes, the alternative to the thing
you don't like is actually something you really don't like.
All right, so if you have missed the news
and have no idea what I'm talking about,
a panel of three federal judges on the appeals court has paused the gag order put in place
by Judge Chutkin.
This is the DC federal case.
The fact that not only are there so many cases, but also cases with gag orders, that in and
of itself should be assigned.
But anyway, this is the DC federal case.
The appeals court has put a pause on that.
Now that's not a determination of the merits of having the gag order in place.
It's giving them time to consider the arguments.
They will hear oral arguments on the 20th, so a couple weeks away.
that time the gag order is not in effect. Now my best guess is that at the end of
this it will go back into effect. That would be my guess on this. If it doesn't
Trump world is going to view it as a win and Trump will view it as a license to
say anything that he wants to, it is worth remembering that some of the
things that Trump has put out on social media could easily be viewed by federal
prosecutors as witness tampering.
It's worth remembering that it does appear that even though they're
prosecuting him. The federal government does seem to be extending courtesies to him that
other defendants wouldn't necessarily get. It is unlikely that those prosecutors would
just be like, okay, say whatever you want to about the witnesses, or, you know, maybe
say that one of them committed a capital offense, or that's fine, don't worry about it. I don't
I don't see that being the attitude that's taken.
So I feel like a win here would actually, a win for Trump would actually put Trump in
more legal jeopardy.
This is one of those moments where it's one of those moments where it might be wise to
remember that good legal advice, just normal good legal advice, would be don't mess with
the witnesses. Set aside the gag order. Just generally speaking, it's not a good idea.
So, we will find out about the gag order towards the end of November. It's also
worth noting that the window is closing on this. We're talking about the end of
November. The trial is currently scheduled for March. All of these things
when they were announced, they were like Star Wars dates way out in the future.
It's not anymore. It's just a few months away. The trial for that will
be here pretty quick.
But that period of time, that is certainly long enough for Trump to tweet his way into
yet another criminal case if he's not careful, regardless of a gag order.
Anyway, it's just a thought.
